Stop the Eviction of IndyCamp at Holyrood

Stop the Eviction of Indycamp, who campaign, not just for Independence but on a wide array of issues including Austerity, Benefits, Pensions, Fundamental Rights & Freedoms and other Social Injustices.

Why is this important?

Indycamp is not just a pro-independence camp outside of Holyrood, despite how it is portrayed in the media. It is a camp which continually educates and engages in political discussion about some of the worst social injustices we face as a society. Whether that be unregulated banking, general corruption, austerity, benefits and the vilification of benefits claimants, the NHS or for the poorest and most vulnerable in our society - it has continually brought to light some of the more severe issues we face as a society.

This case is about more than just the removal of a camp, whether most people realise it or not, it is about the way in which the camp is being removed. You see, Government have used the Scotland Act to transfer public assets, namely the ground around parliament, to a private body, known as the Parliamentary Corporate Body. This body, has at its disposal the full force of parliament and government without having to justify itself to parliament. This sets a dangerous precedent, because when the SPCB took the camp to court, they did so under private law of a corporation and not law applicable to a public organisation. In otherwords, the precedent this sets, is to allow public organisations to transfer land and assets to private entities in order to usurp the public's fundamental rights and freedoms, particularly the freedom to protest your own government in a manner of your choosing should you remain peaceful.

In a nutshell, it sets the precedent, that all any publicly accountable organisation need do, is transfer its assets to a corporate body and suddenly it does not have to deal with being publicly accountable.

I am asking you to support the camp today, not for them, but for yourselves. It is not acceptable for assets you own as a member of the public to be transferred to a private entity. I am asking you to support the camp, because the precedent this will set will erode, not only those at the camps fundamental rights, but also yours as an individual. One day you may wake up after suffering injustice and find that you have to seek permission (like indycamp) from the people you wish to protest, and if you fail to do so, you will find yourself in court, bankrupt and destitute because you refused to ask their permission to protest them. The precedent before the court, of course being the SPCB vs Indycamp.

This is not about a camp and land, it is about your fundamental human rights, which you should never have to ask for, but instead should just automatically have.

The camp needs you more than ever, not for them, but for your own fundamental rights.
1. We need you to right to your MSP's and MP's, to your councillors and to the SPCB. Tell them that you want the camp to stay and to direct the SPCB to stop what they are doing. Tell them that you want to exercise your right to defend the principle and the right of freedom of assembly through peaceful means.

3. Write to your newspapers and media outlets and ask the question. Why are my MSP's not standing up for my rights?
Let me be clear - this is not about the camp. This is about the fundamental fact that in 2, 3, 5, 10 years you may be the victim of a severe injustice, you may wish to hold your leaders to account and you may end up in court, bankrupt and destitute and the precedent that will be used to do that will be the SPCB vs Indycamp.

This is not an issue of pro-independence, nor anti-independence, nor politics or viewpoint, it is about the fundamental principle that you have the right as a citizen of scotland to hold your leaders to account in a manner of your choosing, so long as it remains peaceful. MSP's are supposed to be the ones protecting those rights. This is about more than the camp, it is about your right, my right and everyone elses right to peacefully demonstrate in a manner of our choosing.

I was at the camp yesterday when we had a visit from a guy from Catalonia. I had a 1.5 hour conversation with a guy from New Zealand about Scotlands aspirations for independence. I have seen these debates and chats with many a person from a foreign land and each of them walk away with an understanding that all Scotland wants is choice, the freedom to choose.

While we are discussing other legal avenues at this time, this could all be stopped by applying pressure to your MSP's. The parliamentary corporate body can be steered and directed by the MSP's of Parliament and this can be stopped. But the camp needs your help. We need you to contact your MSP's immediately and tell them that you want the camp to stay.

Discussions are ongoing with the camp at this point as to what legal avenue we take from here. But in the mean time, we need you to stand up for your rights, not just the camps, to protest your elected officials in a manner of your choosing so long as you remain peaceful.

Urgent: Please Share

The decision on Indycamps appeal has just arrived back. The court has, despite the obvious convention rights issues, upheld the decision of the previous judge.

The official publishing of it will be available on the Scotcourts Website at around noon.

The precedent is now in law that:

1. You have to ask your parliament permission to go and protest them on their terms in a manner which they choose.

2. All a public body need do to strip away your rights is transfer public assets to a corporate body, thereby squashing your rights.
